Terms of Service

These Terms govern your access to and use of DeepMap (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for an organisation, you agree on its behalf.

1. The Service

DeepMap provides searchable intelligence about NSW development applications, including information about the businesses and people involved. Some features ("Pro") require a paid subscription or a granted entitlement.

2. Acceptable use of personal information

The data includes personal information. You must:

• comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, the Spam Act 2003 (Cth), and the Do Not Call Register Act 2006 (Cth) in any contact you make using the data;
• only use the data for legitimate business purposes;
• not resell, redistribute, scrape, or bulk-export the data or build a competing dataset from it;
• not use the data to harass any person or for any unlawful purpose; and
• honour opt-out and suppression requests, and wash any call lists against the Do Not Call Register.

You acknowledge that when you extract or use personal information from the Service you become an independent entity responsible for your own compliance with the APPs.

3. Intellectual property and licence

We retain all intellectual property in the Service and our compiled database. We grant you a non-exclusive, non-transferable licence to use the Service for your internal business purposes only, subject to these Terms.

4. Data accuracy

Information is compiled from third-party public sources and extracted using automated tools. To the maximum extent permitted by law, we do not warrant that it is accurate, complete or current, and you must independently verify it before relying on it.

5. Consumer guarantees (Australian Consumer Law)

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. To the extent we are permitted to limit our liability for a failure to comply with such a guarantee, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.

6. Limitation of liability

Subject to clause 5, and to the maximum extent permitted by law: we are not liable for any indirect or consequential loss; and our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months before the relevant claim.

7. Indemnity

You indemnify us against loss we suffer arising from your misuse of personal information or your breach of clause 2 (including any breach of the Privacy Act, Spam Act or Do Not Call Register Act).

8. Suspension and termination

We may suspend or terminate access for breach of these Terms. You may stop using the Service at any time.

9. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
